EU court rules streaming pirated content on a Kodi box is now illegal


Let’s get a few things out of the way real quick. Owning a Kodi box is not illegal. Streaming your own purchased content to a Kodi box is not illegal. Selling or installing a Kodi box is not illegal. Streaming pirated content to a Kodi box, however, is now illegal in the European Union. Kodi boxes have become popular, even breaking into the mainstream non-techie realm due to the ability to pull content from across the internet.
Kodi started its life out as XBMC (Xbox Media Center) whose goal was to make the Xbox a whole entertainment system. XBMC was pretty popular with the tech and tinkering crowd but never really caught on with the public. The XBMC project has since morphed into Kodi and has become even more user-friendly and easy to use. Kodi itself is nothing more than software that manages your local and online content. It provides a nice user interface which has the look and feel of popular streaming services like Netflix and Hulu.
You can use Kodi to access your local content or access services like Netflix, Hulu, YouTube and all of the normal streaming services. Let’s face it though, everyone knows by now, Kodi also allows you to access other streaming options. The streaming options I speak of are generally sources that host and stream loads of illegally gotten content. Out of the box, a Kodi box doesn’t work with these sources, the user must set those sources up themselves. Kodi even puts a disclaimer on their software.

Here in the United States, it’s become a business for some buying and setting up Kodi boxes then reselling them for a profit already setup. As we’ve already said, streaming your own content or purchased content to Kodi is not illegal, but it’s always been a gray area when streaming from third-party sources. Now, a court in the EU has ruled that streaming copyrighted content from third-party sources is illegal.
The argument has always been that streaming copyrighted material isn’t illegal because one isn’t storing that material on their own drives. The EU ruling is making that area far less gray with this new ruling.
The Court of Justice of the European Union has categorically ruled that the temporary reproduction of copyright-protected work – without the consent of the rights holder – cannot be deemed as exempt from “right of reproduction”.
In some case, it is perfectly legal to temporarily reproduce a copyrighted work.
Although this is technically what a stream is doing, the EU court has ruled that piracy-friendly boxes do not meet the requirements for this exemption since their temporary transmissions hurt the copyright holder.
The ruling states, “The Court also finds that temporary acts of reproduction, on that multimedia player, of a copyright protected work obtained by streaming on a website belonging to a third party offering that work without the consent of the copyright holder, cannot be exempted from the right of reproduction.”
It adds: “Furthermore, acts of temporary reproduction, on the multimedia player in question, of copyright-protected works adversely affects the normal exploitation of those works and causes unreasonable prejudice to the legitimate interests of the copyright holders because it usually results in a diminution of the lawful transactions relating to those protected works.”
There you have it. The EU is making it much harder for one to want to use a Kodi box for fear of being prosecuted. Of course, there are ways to use the Kodi software to stream from third-party providers and keep your IP safe, use a VPN. Using a VPN  with Kodi service is useful to block your IP address but we also know ISP’s are on the lookout for users who utilize these services. It will be interesting to see how effective this EU ruling is and how many Kodi users actually stop streaming from illegal third-party sources.

Amazon bans selling of 'fully-loaded' Kodi boxes from its website

Amazon has become the latest organisation to help with the ongoing crackdown on the misuse of Kodi boxes.

The US retail giant has banned 'fully loaded' boxes - used by some to illegally stream live sport, TV and films - from being sold on its website.
Users of the perfectly legal unmodified set-top devices can access online content, including official streaming services such as Netflix and Amazon Prime.
But because it uses an open platform, the Kodi software allows users to install additional applications that give them access to copyrighted material – uploaded, shared or streamed from other users across the globe.
Many are selling "fully loaded" boxes, which come pre-packed with these additional apps, with people using it to illegally stream Premier League football matches.
Their popularity is causing concern for UK authorities. In February, five people were arrested for selling "fully loaded" Kodi boxes, the Mirror reports .
The raids were instigated by the Federation Against Copyright Theft (FACT), on behalf the Premier League, Sky, BT Sport and Virgin Media.

What is Kodi?

Kodi is a free media player that can run on any computer, smartphone, tablet or set-top box, allowing users to stream films and TV programmes over the internet.
A "Kodi box" is a set-top box or the Kodi media player can be installed on a streaming stick like the Amazon Fire.

Is it legal?

The software itself is not illegal, nor is it illegal to sell devices with Kodi pre-installed on them.
However, many of these Kodi devices come pre-loaded with third party plug-ins and add-ons that allow users to stream pirated content to their TV.
Selling these "fully loaded" TV set-top devices is a breach of the Copyright, Designs and Patent Act 1988.
Individuals involved in this crime may also be breaking the Fraud Act, and be charged with money laundering offences, according to FACT.

What is Amazon doing?

Amazon is now banning all devices such as Kodi boxes, which can be uploaded with software that make it easy for viewers to watch paid-for programmes such as Premier League football live games for free.
The company has now announced that anyone caught using its Amazon Marketplace to sell devices that "promote, facilitate or enable" illegal access to copyrighted TV and films for free will now have their accounts suspended.
Sellers who violate the policy could have stock stored in Amazon fulfilment centres destroyed with no reimbursement, the company has warned.
Amazon has never explicitly permitted the sale of these copyright-infringing set-top boxes, however, it was possible to find sellers within the online marketplace trying to sell them through the retail portal.
The online retailer has now published a notice warning users about selling devices that promote piracy.
The note warns: "Products offered for sale on Amazon should not promote, suggest the facilitation of, or actively enable the infringement of or unauthorised access to digital media or other protected content.
"Any streaming media player or other device that violates this policy is prohibited from sale on Amazon."

Who else is cracking down?

A crackdown by FACT, Greater Manchester Police , City of London Police and the Intellectual Property Office (IPO) is targeting those involved in the sale and distribution of these illegal "fully loaded" devices.
FACT's priority is to "disrupt and combat individuals manufacturing, importing, selling and re-selling these illegal devices".
While the end user is not a target, they could get swept up in one of FACT's operations, and could become part of the whole criminal investigation, the organisation said.
Of course, this doesn't stop people from buying "clean" Kodi boxes, and then downloading the copyright infringing add-ons themselves.
Many people also download the Kodi media player onto another TV streaming device - such as a Google Chromecast or Amazon Fire TV Stick - and install the plug-ins from there.

What are the penalties?

The penalties for sellers are high - it could result in time behind bars.
In December 2016, Terry O'Reilly was sentenced to four years imprisonment for selling illegal set-top TV boxes, a prosecution brought by the Premier League with support from FACT.
Meanwhile in February, set-top boxes pre-loaded with Kodi streaming software were seized at the homes of the five suspects in Bolton, Bootle, Cheadle, Manchester and Rhyl.
It is believed the suspects had made in the region of £250,000 selling the devices online.

What about penalties for people using the boxes?

FACT claims that "if you are accessing premium pay-for content, like Sky, BT Sport and Virgin Media, and you do not have a subscription with an official provider then this is unlawful access".
However, it is unclear exactly what law you would be breaking.
If you were to download an illegally copied file, that would constitute copyright infringement. However, when you stream something online, the file is stored only temporarily on your computer - and temporary copies are exempt from copyright laws.
In a landmark ruling in 2014, the Court of Justice of the European Union ruled that internet users who look at copyrighted material online aren't breaking the law by doing so, citing Article 5.1 of the EU Copyright Directive.
It stated that copies of copyrighted material that appear "on the users computer screen" and "in the internet 'cache' of that computer's hard disk" are "temporary" and "may therefore be made without the authorisation of the copyright holders".
Morally, of course, it's a completely different matter.
Anyone accessing content from a pirate site is involving themselves in unlawful behaviour, often putting money into the hands of criminals.
They are also undermining the legitimate sale of subscription TV services, which employ tens of thousands of people in the UK, and whose contributions are key to the creative and sporting industries.
Furthermore, accessing illegal sites can leave your computer vulnerable to viruses and other harmful content.

What is the Premier League doing?

The Premier League says it has launched its "largest ever" crackdown on streaming devices.

A spokesman for the Premier League said: "We are currently engaged in our largest ever anti-piracy campaign to protect our copyright.
"Like other sports and creative industries our model is predicated on the ability to market and sell rights and protect our intellectual property.
"It is because of this that clubs can invest in and develop talented players, build world-class stadiums, support the English football pyramid and schools and communities across the country – all things that fans enjoy and wider society benefits from."

What is Kodi doing to prevent illegal streaming?

We weren't able to get hold of anyone from Kodi to discuss the steps the company is taking to prevent its media player from being used for illegal streaming.
In the past, the company has maintained an officially neutral stance on what users do with their own software.
"Kodi is open source software, and as long as the GPL (General Public License) is followed, you are welcome to do with it as you like," Kodi Product Manager Nathan Betzen told TorrentFreak last year.
"While we don't love this use of Kodi, as long as you know what illegal and potentially dangerous things you are getting yourself into and accept the fact that the team will not be providing you with any support, then you are welcome to do what you like."
However, the company is going after sellers who use the Kodi trademark to flog fully-loaded set-top boxes without permission.
"We will issue trademark takedown notices anywhere we think the likelihood for confusion is high," said Betzen.
"If you are selling a box on your website designed to trick users into thinking broken add-ons come from us and work perfectly, so you can make a buck, we're going to do everything we can to stop you."
